Scope: The following general terms and conditions apply to all contracts concluded with EMBAWO OHG, hereinafter "embawo", and the end user for the purchase and delivery of goods from embawo catalogs, regardless of the means of communication used.

Prices: The prices given in the catalogs are given in EURO and include the statutory value added tax, but not the shipping costs.

General VAT: VAT-free deliveries within the EU to holders of a valid VAT ID number. are only possible for dealers in the dealer login menu.

Right of Withdrawal: The detailed provisions on the right of withdrawal can be found in the menu item "Right of withdrawal".

Ordering process / conclusion of contract: Orders and deliveries are only possible from / to people who have reached the age of 18. Orders and deliveries from / to people who have not yet reached the age of 18 are not possible.

The presentation of the products and services in the online shop does not constitute a binding contract offer. By sending the order to www.embawo.com, the customer is submitting a binding offer. embawo reserves the right to freely decide whether to accept this offer.

The prices stated for the product offered apply. If information about the products in the e-shop is incorrect, the customer will be presented with a counter offer, which he can freely decide whether to accept.

Vouchers: Only one voucher can be redeemed per order. The voucher is only valid if the voucher code is entered in the course of the order and accepted by the system. Any deduction from or any offsetting with existing outstanding claims is not permitted and will not be accepted. Vouchers have no minimum term and can be deactivated or canceled by embawo at any time, even without prior notice. Orthopant reserves the right not to recognize free vouchers in connection with existing offers.

Colors: There may be color deviations between the colors shown in the catalog / shop and the real colors of the articles. embawo therefore does not guarantee that the colors displayed in the catalog / shop correspond to the real colors of the respective articles.

Retention of title: The goods remain the property of embawo until they have been paid for in full. In the event of behavior contrary to the contract, in particular in the event of default in payment or resale of the goods before the purchase price has been paid in full, embawo reserves the right to assert claims for compensation.

Image rights: All image rights in the EMBAWO online shop, as well as in all catalogs and similar documents, belong to EMBAWO OHG. Use without express permission is prohibited.

Information by e-mail: Customers of the EMBAWO online shop receive information at irregular intervals to the e-mail address specified during registration or purchase, possibly changed afterwards, which commercial offers, general product and / or user information on the subject of products from the Alps as well as free shopping vouchers. A free cancellation from the distribution system or a deletion of personal data is possible at any time and can be requested at any time by telephone, fax or e-mail in a simple form. Customer data will NOT be passed on to third parties and will be treated with the greatest possible confidentiality. Warranty: embawo adheres to the statutory warranty regulations in the event of defects in the purchased goods. Obvious material or manufacturing defects in the delivered items should be reported to embawo immediately.
embawo is not liable for errors that occur in the application by the user / buyer.

Liability: We assume no liability for any printing or display errors in any advertising material that are due to slight negligence. With regard to other damages, embawo is not liable for slight negligence.

Deviating conditions of the buyer: In the event that the customer uses his own general terms and conditions, which deviate from these general terms and conditions in terms of content, the general terms and conditions of embawo.

Miscellaneous: Should a provision in these terms and conditions be or become ineffective, this shall not affect the validity of all other provisions. Ineffective provisions will be replaced by legally permissible provisions that come closest to the economic purpose intended by the parties.

Languages: This text and all other texts are available in German and Italian. The texts in German and Italian have legal relevance.

Applicable law and place of jurisdiction: Italian law is applicable to these general terms and conditions to the exclusion of the provisions on international private law and to the exclusion of the UN sales law. The place of jurisdiction is Bolzano (BZ), Italy.
